The completion of the specific legislation establishing the conditions under which foreign workers can take up a new job with an employer other than the one who obtained the employment permit, during the validity of the single permit or the EU Blue Card, was necessary to stop the migration of workers once they arrived in Romania.
According to the Ministry of Labour and Social Solidarity, a foreign worker who has had an individual employment contract (CIM) registered for less than a year will be able to take up a new job with another employer only with the written consent of the original employer.
The law also stipulates that if the foreign worker changes his/her place of work but remains with the same employer who obtained the original employment permit, the new permit shall be issued to the employer without fulfilling all the general conditions and, where applicable, without fulfilling all the special conditions for issuing such a document in the case of permanent or trainee workers.
At the same time, a new employment permit shall be issued to another employer, during the period of validity of the single permit or the EU Blue Card, only if all general or special conditions, as the case may be, are met.
These provisions do not apply even if the termination of the CIM has occurred at the initiative of the previous employer, by agreement of the parties or by resignation of the foreign citizen, if the employer does not fulfil the obligations assumed by the CIM, according to Law no. 53/2003 - Labour Code, republished, with subsequent amendments and additions.
