•  provided for by Law no. 286/2009 on the Criminal Code, with subsequent amendments and additions, hereinafter referred to as the Criminal Code;
  has not been sanctioned for undeclared work in the last 6 months prior to the application.

After recruiting foreign employees, the employer has a duty to provide them with accommodation and meals and, as in the case of resident employees, the employer must respect all health and safety at work rules, working hours and the right to rest, provide a set minimum equivalent wage, and if an employee wishes to resign, notify the General Inspectorate for Immigration as soon as possible.

According to the law, a foreign worker who has had an individual employment contract (CIM) registered for less than one year will be able to take up a new job with another employer only with the written consent of the original employer.

We present below the approximate deadlines for the solution of each stage to be completed:

Selection and recruitment stage:

• from 3 working days up to 1 month depending on the qualifications and experience required and the financial offer of the employer;
• obtaining the employment permit: 20-60 days depending on the employment level of the Immigration Service in the county in which we apply;
• obtaining the long stay visa for work purposes: 2 weeks-3 months depending on the country of origin of the Asian workers.
